1. Agreement of Use
Welcome to the MobilOS platform ('Service'). These Terms of Service ('Terms') constitute a legal agreement between you ('Client') and MobilOS, governing your access and use of our platform. By registering or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms.
2. The MobilOS Service
MobilOS is a software as a service (SaaS) platform designed to optimize the management of field teams, service orders, clients, and quotes. The specific functionalities you have access to are determined by your subscription plan. We are constantly evolving and reserve the right to modify or discontinue Service functionalities, always seeking to improve the user experience.
2.1. Availability and Maintenance
Our goal is to keep the Service accessible and functional. However, scheduled maintenance or emergency updates may be necessary, resulting in temporary interruptions. We will do our best to communicate planned maintenance in advance. Access to the Service may also be affected by external factors, such as internet network instabilities, for which we cannot be held responsible.
3. User Accounts and Security
The Client is solely responsible for protecting the confidentiality of their passwords and for all activities that occur under their account. The user with the 'MANAGER' role holds administrative responsibility over other users of their organization. It is crucial that you notify us immediately of any suspicion of unauthorized use.
3.1. User Conduct
You agree to use the Service for legitimate purposes and in compliance with these Terms. It is prohibited to use the Service in a manner that could damage, overload, or impair our infrastructure, or interfere with the use of other clients.
4. Subscriptions and Payments
Access to the Service is granted through subscription plans, detailed on our Plans page. Charges are recurring, and renewal is automatic. Subscription cancellation can be made at any time through the billing portal and will take effect at the end of the current billing cycle.
4.1. Refund Policy
Subscription payments are non-refundable, except when required by law. Cancellation of the subscription prevents future charges but does not generate credit or refund for partial periods of use.
5. Ownership and Responsibility for Data
All data you enter into the Service, including information about your clients, service orders, photos, and quotes ('Client Data'), is your exclusive property. For us to operate the Service, you grant us a limited license to host, process, and display this data.
5.1. Your Role as Data Controller
In the context of the General Data Protection Law (LGPD), you, the Client, act as the **Controller** of your own clients' personal data that you enter into the platform. MobilOS acts as the **Processor** of this data, acting under your instructions. It is your responsibility to ensure that the collection and use of this data comply with applicable legislation.
The accuracy and legality of Client Data are your sole responsibility. We recommend that the Client maintain independent backup routines for their critical data. MobilOS is not responsible for data loss resulting from failures not directly attributable to our infrastructure.
6. Inactive Account Policy
To maintain the health and security of our platform, organizations' accounts that do not have an active paid subscription and show inactivity (no MANAGER user login) for a continuous period of **90 (ninety) days** will be considered abandoned.
Accounts classified as abandoned, along with all their data, may be permanently removed from our systems. Reactivation of the account through login or contracting a subscription at any time during this 90-day period cancels the deletion process.
7. Termination
You may terminate your account at any time by canceling your subscription. We also reserve the right to suspend or terminate your account if you materially violate these Terms, if there is non-payment, or if the use of your account poses a risk to the security or integrity of the platform.
8. Limitation of Liability
The Service is provided 'as is'. We strive to offer the best possible experience, but we do not guarantee that the Service will be uninterrupted, error-free, or that it will meet all your specific expectations.
To the maximum extent permitted by law, MobilOS's total liability for any claim arising from these Terms, including any implied warranties, is limited to the amount you paid us to use the Service in the last 12 months.
9. Changes to Terms
We may revise these Terms periodically. If a change is material, at our discretion, we will notify users with reasonable advance notice. By continuing to use the Service after the changes take effect, you agree to the revised Terms.
